Apostle Asset Management Limited (APOSTLE) is bound by:
- the National Privacy Principles in the Privacy Act 1988 (Cth) (Australian Privacy Act) where a person accesses the Apostle Site from Australia; and
- the Information Privacy Principles in the Privacy Act 1993 (New Zealand Privacy Act) where a person accesses the Apostle Site from New Zealand.
If a person applies for units in any of the Funds or engages Apostle to provide investment services, he or she will be asked to provide personal information to Apostle (and to the administrator and custodian of the relevant Fund which is appointed by Apostle) which collects, holds and uses that information for the purposes of managing their investment.
We may use any information that a person directly or indirectly transmit or otherwise provide to us to help ensure that we provide that person with a quality service. In addition, we may use the personal information we receive to provide additional information about the full range of services offered by Apostle and/ or its related bodies corporate (Apostle Group). If a person does not want to receive this information he or she can let Apostle know by sending us an email.
We will take reasonable steps to ensure that any identifiable personal information that we have collected is stored securely and it will not be disclosed outside of the Apostle Group and the authorised service providers to which we outsource certain functions, without your consent.
Where appropriate, we will handle personal information relying on the related bodies corporate exemption.
We usually collect personal information such as a person's name, address and contact details. As a general rule, we do not collect sensitive information as defined in the Australian Privacy Act. However, if we do, it will usually be for the purposes of providing our services and we will seek that person's consent to collect it.
We usually share this information with other members of the Apostle Group both in Australia and overseas and with authorised service providers to which we outsource certain functions, including the administration, custodian and investment management in respect of the Funds. This may involve the transfer of personal information overseas and where this occurs, you consent to the transfer of your personal information to the destination overseas nominated by the Apostle Group.
In accordance with the Australian Privacy Act and New Zealand Privacy Act, a person has a right to access any personal information we hold about them and correct any personal information that may be incorrect. A person may request access to their information or make a complaint concerning their information privacy. We may deny such a request in some circumstances, if we do this we will explain why.
